Terms of Service

These terms govern your use of our website or services such as Digital Coating(Dico) (collectively, “Services”) and software that we include as part of the Services, including any applications, User Files (as defined below), scripts, instruction sets, and any related documentation (collectively “Software”).
By using the Services or Software, you agree to these terms. If you have entered into another agreement with us concerning specific Services or Software, then the terms of that agreement controls where it conflicts with these terms.
As discussed further in Section 3 below, you retain all rights and ownership you have in your content that you make available through the Services.
By using our services, you may upload or otherwise provide files and information and process such files and information (“User Files” whether originally provided by you or processed by using our services) to us.

1. How this Agreement Works

 2.2 Digital Coating(Dico) Intellectual Property
  We (and our licensors) remain the sole owner of all right, title, and interest in the Services and Software. We reserve all rights not granted under these terms. You are especially not allowed to resell any of our products, Software and/or Services.

 2.3 Pre-release Version
  We may designate the Software or Services, or a feature of the Software or Services, as a pre-release or beta version (“Pre-release Version”).
  Pre-release Version does not represent the final product and may contain bugs that may cause system or other failures and data loss. We may choose not to commercially release the Pre-release Version.
  You must promptly cease using the Pre-release Version and destroy all copies of Pre-release Version if we request you to do so, or if we release a commercial version of the Pre-release Version.
  Any separate agreement we enter into with you governing the Pre-release Version will supersede the provisions on Pre-Release Version set out in this section.

3. Your Content
 3.1 Ownership
  You retain all rights and ownership of your content. We do not claim any ownership rights to your content.

 3.2 Our Access
  We will only access, view, or listen to your content in limited ways. 
  For example, in order to perform the Services, we may need to access, view, or listen to your content to (a) respond to support requests; (b) detect, prevent, or otherwise address fraud, security, unlawful, or technical issues; (c) improve our Services and (d) enforce these terms.

You are responsible for all activity that occurs via your account. Please notify Customer Support immediately if you become aware of any unauthorized use of your account.
You may not (a) share your account information (except with an authorized account administrator) or (b) use another person’s account.
Your account administrator may use your account information to manage your use and access to the Services.

5. User Conduct
 5.1 Responsible Use
  You must use the Services responsibly.

 5.2 Misuse
  You must not misuse the Services, Software, or content that we provide to you as part of the Services or Software. For example, you must not:
  (a) copy, modify, host, stream, sublicense, or resell the Services, Software, or content;
  (b) enable or allow others to use the Service, Software, or content using your account information;
  (c) use the content or Software included in the Services to construct any kind of database;
  (d) access or attempt to access the Services by any means other than the interface we provided or authorized;
  (e) circumvent any access or use restrictions put into place to prevent certain uses of the Services;
  (f) share content or engage in behavior that violates anyone’s Intellectual Property Right (“Intellectual Property Rights” means copyright, moral rights, trademark, trade dress, patent, trade secret, unfair competition, right of privacy, right of publicity, and any other proprietary rights.);
  (i) attempt to disable, impair, or destroy the Services, software, or hardware;
  (k) engage in chain letters, junk mails, pyramid schemes, spamming, or other unsolicited messages;
  (l) place advertisement of any products or services in the Services except with our prior written approval;
  (m) use any data mining or similar data gathering and extraction methods in connection with the Services;
  (n) violate applicable law or encrypt or protect files in countries where this is prohibited

6. Your Indemnification Obligations
You will indemnify us and our subsidiaries, affiliates, officers, agents, employees, partners, and licensors from any claim, demand, loss, or damages, including reasonable attorneys’ fees, arising out of or related to your content, your use of the Services or Software, or your violation of these terms.

7. Disclaimers of Warranties
 7.1 Warranties of Services and Software
  The Services and Software are provided “AS-IS”. To the maximum extent permitted by law, we disclaim and exclude any and all warranties express or implied, including the implied warranties of non-infringement, merchantability, or fitness for a particular purpose.
  We make no commitments about the content within the Services.
  We further disclaim and exclude any and all warranty that (a) the Services or Software will meet your requirements or will be constantly available, uninterrupted, timely, secure, or error-free; (b) the results that may be obtained from the use of the Services or Software will be effective, accurate, or reliable; (c) the quality of the Services or Software will meet your expectations; or that (d) any errors or defects in the Services or Software will be corrected.

 7.2 Liability of Services and Software
  We specifically disclaim any liability for any actions resulting from your use of any Services or Software.

 7.3 Storage of files
  Our storage functionality is available cross-platform. We can’t promise that stored files will always appear to or be accessible by you.
  You should always have a copy of your document saved on your own device. We are not responsible for lost documents and cannot be held liable for any loss.

8. Limitation of Liability
 8.1 Liability of Digital Coating(Dico)
  Digital Coating(Dico) is not liable to you or anyone else for: (a) any loss of use, data, goodwill, or profits, whether or not foreseeable; and (b) any special, incidental, indirect, consequential, or punitive damages whatsoever (even if we have been advised of the possibility of these damages), including those (x) resulting from loss of use, data, or profits, whether or not foreseeable, (y) based on any theory of liability, including breach of contract or warranty, negligence or other tortious action, or (z) arising from any other claim arising out of or in connection with your use of or access to the Services or Software. Nothing in these terms limits or excludes our liability for gross negligence, for our (or our employees’) intentional misconduct, or for death or personal injury.

 8.2 Limited liability
  Digital Coating(Dico)’s total liability in any matter arising out of or related to these terms is limited to the aggregate amount that you paid for access to the Service and Software during the three-month period preceding the event giving rise to the liability, whichever is higher.
  This limitation will apply even if we have been advised of the possibility of the liability exceeding the amount and notwithstanding any failure of essential purpose of any limited remedy.

 8.3 Limitation
  The limitations and exclusions in this Section 8 apply to the maximum extent permitted by law.

9. Termination
 9.1 Termination by You
  You may stop using the Services at any time.

 9.2 Termination by Us
  Digital Coating(Dico) may terminate the Service/this agreement at any time. 
  If we terminate these terms for reasons other than for cause, then we will make a reasonable effort to notify you at least 30 days prior to termination via the email address you provide to us with instructions on how to retrieve your content. We may, at any time, terminate your right to use and access the Services or Software if:
  (a) you breach any provision of these terms (or act in a manner that clearly shows you do not intend to, or are unable to, comply with these terms);
  (b) we are required to do so by law (for example, where the provision of the Services or Software to you is, or becomes, unlawful);
  (c) we elect to discontinue the Services or Software, in whole or in part, (such as if it becomes impractical for us to continue offering Services in your region due to change of law); or
  (d) there has been an extended period of inactivity in your free account.

9.3 Survival
Upon expiration or termination of these terms, any perpetual licenses you have granted, your indemnification obligations, our warranty disclaimers or limitations of liabilities, and dispute resolution provisions stated in these terms will survive. Upon the expiration or termination of the Services, some or all of the Software may cease to operate without prior notice.

10. Investigations / Disclosure
We may access or disclose information about you, or your use of the Services, (a) when it is required by law; (b) to respond to your requests for customer service support; or (c) when we, in our discretion, think it is necessary to protect the rights, property, or personal safety of us, our users, or the public.

11. Dispute Resolution
 11.1 Process
  For any concern or dispute you may have, you agree to first try to resolve the dispute informally by contacting us. If a dispute is not resolved within 30 days of submission, you or Digital Coating(Dico) must resolve any claims relating to these terms, the Services, or the Software through final and binding arbitration, except that you or Digital Coating(Dico) may assert claims before the courts of Seoul, South Korea.

 11.2 Rules
  If you or Digital Coating(Dico) decide to resort to arbitration as per the foregoing paragraph, the Korea Chambers’ Arbitration Institution will administer the arbitration in Seoul under the Korea Rules of International Arbitration. There will be one arbitrator that you and Digital Coating(Dico) both select. The arbitration will be conducted in the English language(or Korean language). Judgment upon the award rendered may be entered and will be enforceable in any court of competent jurisdiction having jurisdiction over the parties.

 11.3 No Class Actions
  You may only resolve disputes with us on an individual basis, and may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action.

 11.4 Injunctive Relief
  Notwithstanding the foregoing, in the event of your or others’ unauthorized access to or use of the Services or content in violation of these terms you agree that we are entitled to apply for injunctive remedies (or an equivalent type of urgent legal relief) in any jurisdiction.

12. Modification
We may modify these terms or any additional terms that apply to a Service or Software in order to, for example, reflect changes to the law or changes to our Services or Software.
You should look at the terms regularly. We will post notice of modifications to these terms on this page. We will post notice of modified additional terms in the applicable Service or Software.
By continuing to use or access the Services or Software after the revisions come into effect, you agree to be bound by the revised terms.

  당사는 귀하 또는 다른 사람에 대한 책임 없이 언제든지 서비스, 소프트웨어(해당 부분 또는 기능 포함)를 수정, 업데이트 또는 중단할 수 있습니다.

  당사는 소프트웨어 또는 서비스 또는 소프트웨어 또는 서비스의 기능을 시험판 또는 베타 버전("시험판 버전")으로 지정할 수 있습니다. 시험판 버전은 최종 제품을 나타내지 않으며 시스템 또는 기타 오류 및 데이터 손실을 유발할 수 있는 버그를 포함할 수 있습니다.

 귀하는 당사와 당사의 자회사, 계열사, 임원, 대리인, 직원, 파트너 및 라이센서로부터 귀하의 콘텐츠, 서비스 또는 소프트웨어의 사용 또는 본 약관의 위반으로 인해 발생하거나 관련된 합리적인 변호사 비용을 포함한 모든 청구, 요구, 손실 또는 손해에 대해 보상합니다.

7. 보증 거부
 7.1 서비스 및 소프트웨어 보증
  서비스 및 소프트웨어는 "있는 그대로-AS-IS" 제공됩니다. 법이 허용하는 최대 범위 내에서 당사는 비침해, 상품성 또는 특정 목적에의 적합성에 대한 묵시적 보증을 포함하여 명시적 또는 묵시적 모든 보증을 부인하고 배제합니다.
  당사는 서비스 내의 콘텐츠에 대해 어떠한 약속도 하지 않습니다. 
  당사는 (a) 서비스 또는 소프트웨어가 귀하의 요구 사항을 충족하거나 지속적으로 사용 가능하고, 중단되지 않고, 시기 적절하고, 안전하거나, 오류가 없을 것이라는 모든 보증을 거부하고 배제합니다. 
  (b) 서비스 또는 소프트웨어의 사용으로 얻을 수 있는 결과는 효과적이고 정확하거나 신뢰할 수 있습니다. (c) 서비스 또는 소프트웨어의 품질이 귀하의 기대치를 충족할 것입니다. 또는 (d) 서비스 또는 소프트웨어의 오류 또는 결함이 수정됩니다.

 7.2 서비스 및 소프트웨어의 책임
  당사는 귀하의 서비스 또는 소프트웨어 사용으로 인한 조치에 대해 구체적으로 어떠한 책임도 지지 않습니다. 
  귀하는 자신의 재량과 위험에 따라 서비스 또는 소프트웨어를 사용 및 액세스할 수 있으며 서비스 또는 소프트웨어의 사용 및 액세스로 인해 발생하는 컴퓨터 시스템의 손상 또는 데이터 손실에 대해 단독 책임이 있습니다.

 7.3 파일 저장
  당사의 스토리지 기능은 플랫폼 간에 사용할 수 있습니다. 저장된 파일이 항상 귀하에게 나타나거나 귀하가 액세스할 수 있다고 보장할 수는 없습니다. 
  항상 자신의 장치에 문서 사본을 저장해야 합니다. 분실된 문서에 대해서는 책임을 지지 않으며 어떠한 손실에 대해서도 책임을 지지 않습니다.

8. 책임의 제한
 8.1 디지털 코팅(Digital Coating-Dico)의 책임
  디지털 코팅(Digital Coating-Dico)은 다음 사항에 대해 귀하 또는 다른 누구에게도 책임을 지지 않습니다. (b) (x) 사용, 데이터 또는 이익의 손실로 인한 손해를 포함하여 모든 특별, 부수적, 간접적, 결과적 또는 징벌적 손해(이러한 손해의 가능성에 대해 당사가 통보를 받은 경우에도 해당) 예측 불가, (y) 계약 또는 보증 위반, 과실 또는 기타 불법 행위를 포함한 책임 이론에 근거하거나, (z) 서비스 사용 또는 액세스와 관련하여 발생하는 기타 청구에서 발생 또는 소프트웨어. 본 약관의 어떠한 내용도 중과실, 당사(또는 당사 직원)의 고의적 위법 행위, 사망 또는 부상에 대한 당사의 책임을 제한하거나 배제하지 않습니다.

 8.2 유한 책임
  본 약관으로 인해 또는 이와 관련하여 발생하는 모든 문제에 대한 디지털 코팅(Digital Coating-Dico)의 총 책임은 책임이 발생한 사건 이전 3개월 동안 서비스 및 소프트웨어에 대한 액세스를 위해 지불한 총 금액 중 다음 조건으로 제한됩니다.
  이 제한은 책임이 금액을 초과할 가능성에 대해 조언을 받은 경우에도 그리고 제한적 구제의 본질적인 목적을 달성하지 못한 경우에도 적용됩니다.

 8.3 제한
 이 섹션 8의 제한 및 배제는 법이 허용하는 최대 범위까지 적용됩니다.

9. 해지
 9.1 귀하에 의한 해지
  귀하는 언제든지 서비스 사용을 중지할 수 있습니다.

 9.2 당사에 의한 해지
  디지털 코팅(Digital Coating-Dico)은 언제든지 서비스/본 계약을 종료할 수 있습니다.
  당사가 사유가 아닌 다른 이유로 본 약관을 해지하는 경우, 당사는 귀하가 당사에 제공한 이메일 주소를 통해 해지 최소 30일 전에 귀하에게 콘텐츠 검색 방법에 대한 지침을 알리기 위해 합당한 노력을 기울일 것입니다.
  당사는 다음과 같은 경우 서비스 또는 소프트웨어를 사용하고 액세스할 수 있는 귀하의 권리를 언제든지 종료할 수 있습니다.
  (a) 귀하가 본 약관의 조항을 위반하는 경우(또는 귀하가 본 약관을 준수할 의사가 없거나 준수할 수 없음을 분명히 보여주는 방식으로 행동)
  (b) 법률에 따라 그렇게 해야 하는 경우(예: 귀하에 대한 서비스 또는 소프트웨어의 제공이 불법이거나 불법이 되는 경우)
  (c) 당사가 서비스 또는 소프트웨어의 전체 또는 일부를 중단하기로 선택한 경우(예: 법률 변경으로 인해 귀하의 지역에서 서비스를 계속 제공하는 것이 비현실적인 경우) 또는
  (d) 귀하의 무료 계정이 장기간 비활성 상태였습니다.

 9.3 유지
  본 약관이 만료되거나 종료되면 귀하가 부여한 영구 라이선스, 귀하의 면책 의무, 보증 거부 또는 책임 제한, 본 약관에 명시된 분쟁 해결 조항은 존속합니다. 서비스가 만료되거나 종료되면 소프트웨어의 일부 또는 전체가 사전 통지 없이 작동을 중단할 수 있습니다.

10. 조사/공개
당사는 귀하 또는 귀하의 서비스 이용에 대한 정보를 액세스하거나 공개할 수 있습니다. (a) 법률에 의해 요구되는 경우, (b) 고객 서비스 지원에 대한 귀하의 요청에 응답하기 위해, 또는 (c) 당사 재량에 따라 당사, 사용자 또는 일반인의 권리, 재산 또는 개인 안전을 보호할 필요가 있다고 판단될 때.

11. 분쟁 해결
 11.1 프로세스
  문제가 있거나 분쟁이 있을 경우 먼저 당사에게 연락하여 비공식적으로 분쟁을 해결하도록 하는 데 동의합니다. 제출 후 30일 이내에 분쟁이 해결되지 않을 경우, 귀하 또는 디지털 코팅(Digital Coating-Dico)은 최종적이고 구속력 있는 중재를 통해 본 약관, 서비스 또는 소프트웨어와 관련된 모든 클레임을 해결해야 합니다. 단, 귀하 또는 디지털 코팅(Digital Coating-Dico)은 대한민국 서울 법원에서 클레임을 주장할 수 있습니다.

 11.2 규칙
  귀하 또는 디지털 코팅(Digital Coating-Dico)이 앞 단락에 따라 중재를 하기로 결정하면 대한민국 서울 중재 기관은 중재 규칙에 따라 서울에서 중재를 관리합니다. 귀하와 디지털 코팅(Digital Coating-Dico) 둘 다 선택하는 중재자가 한 명 있을 것입니다. 중재는 영어(또는 한국어)로 진행될 것이다. 판결에 대한 판결은 각 당사자에 대한 관할권을 가진 관할권의 모든 법원에서 집행될 수 있다.

 11.3 등급 조치 없음
  귀하는 당사와의 분쟁을 개별적으로만 해결할 수 있으며, 원고 또는 집단 구성원으로서의 클레임, 연결 또는 대표 소송을 제기할 수 없습니다.

 11.4 명령적 구제
  전술한 내용에도 불구하고, 귀하 또는 다른 사용자가 본 약관을 위반하여 본 서비스 또는 컨텐츠에 무단 액세스하거나 사용하는 경우 귀하는 당사가 모든 관할 구역에서 명령적 구제(또는 이와 동등한 유형의 긴급 법적 구제)를 신청할 수 있다는 데 동의합니다.

12. 변경
당사는 예를 들어 법률의 변경 또는 당사의 서비스 또는 소프트웨어에 대한 변경을 반영하기 위해 서비스 또는 소프트웨어에 적용되는 이러한 약관 또는 추가 약관을 수정할 수 있습니다.
귀하는 정기적으로 용어를 살펴봐야 합니다. 저희는 이 용어의 수정에 대한 통지를 이 페이지에 게시할 것이다. 수정된 추가 약관은 해당 서비스 또는 소프트웨어에 게시됩니다. 
개정판이 발효된 후에도 서비스 또는 소프트웨어를 계속 사용하거나 액세스함으로써 사용자는 개정된 약관에 구속되는 데 동의합니다.

  이러한 용어의 영어 버전은 이러한 용어를 해석하거나 해석할 때 사용되는 버전이 됩니다.

 13.3 귀하에게 통지
  당사는 전자 메일, 우편, 서비스 내의 게시물 또는 기타 법적으로 허용되는 방법을 통해 귀하에게 통지할 수 있습니다.

 13.4 전체 계약
  이러한 조항은 귀하의 서비스 및 소프트웨어 사용에 관한 귀하와 당사 사이의 전체 계약을 구성하며, 본 서비스와 관련된 귀하와 당사 간의 이전 계약을 대체합니다.

 13.5 미할당
  귀하는 당사의 서면 동의 없이 본 약관 또는 본 약관에 따른 귀하의 권리와 의무를 전부 또는 부분적으로 양도하거나 양도할 수 없으며, 이러한 시도는 무효가 됩니다. 당사는 본 조건에 따른 권리를 제3자에게 양도할 수 있습니다.

 13.6 분리성
  특정 용어가 시행 가능하지 않다면, 해당 용어의 시행 불가능성은 다른 용어에 영향을 미치지 않을 것이다.

 13.7 포기 금지
  이러한 조건을 시행하거나 행사하지 않은 것은 해당 조항의 포기가 아닙니다.
